Privacy Policy - Clinical Data
7.1 Access to the health record for healthcare purposes.
7.1.1 Article 15.2 of the LBAP establishes that the purpose of the health record is "to facilitate healthcare by recording all data that, under medical criteria, allow for accurate and up-to-date knowledge of the state of health."
According to the same law in Article 16.1, healthcare professionals involved in the diagnosis or treatment of a patient have access to the patient's health record as an essential tool for proper care, without the need for the patient's consent.
Therefore, residents in training of any year, as healthcare personnel and employees of the Center, have the right to access the health records of patients involved in their healthcare activities at any given time. Failure to consult or complete healthcare actions in the health record may have implications for patient safety and legal consequences due to clinical malpractice.
7.1.2 The responsible party of the healthcare center, through the administrative service in charge of managing the medical records archive, will provide residents with access to the health records by means of an authentication mechanism (usually through an identification card and recognized electronic signature) that will be progressively implemented within six months from the notification of this agreement to the Health Departments of the autonomous communities and the National Institute of Health Management.
In accordance with Article 16.7 of the LBAP, the procedure used shall ensure that the access to the health record and its use is recorded.
In exceptional cases, healthcare center authorities may establish limitations on healthcare professionals' access to the health records based on the care context and the healthcare center's access policy (for example, regarding cases of gender-based violence, press policy, etc.), as long as these limitations, in accordance with the provisions of Article 76 of the LOPD in relation to Article 16 of the LBAP, do not hinder care, prevention, and diagnosis, nor prevent the safeguarding of the vital interests of the affected individuals.
In any case, access authorizations shall be temporary and shall expire when the training period ends, at which point the healthcare center will deactivate the resident's access instrument to the health records.
7.1.3 In order to guarantee respect for the privacy and confidentiality of health data, students may only access the health records in accordance with the provisions of Article 16.3 of the LBAP, which requires the prior dissociation of clinical data from personal data to ensure anonymity.
The above provision does not apply in cases where the patient themselves have given explicit consent not to alter or dissociate any data, in which case the consent will be attached to the health record.
7.2 Access to the health record for epidemiological, public health, research, or educational purposes.
7.2.1 The LBAP, in Article 16.3, establishes that access to the health record for judicial, epidemiological, public health, research, or educational purposes requires the preservation of the patient's personal identification data, separated from the clinical data, so that, as a general rule, anonymity is ensured unless the patient themselves have given their consent not to separate them.
The dissociation of data requires separating the clinically relevant data (in this case, clinical and healthcare data) from those that allow for the identification of the individual (such as medical record number, social security number, ID card, etc.). The dissociation of data must be carried out by a healthcare professional subject to professional secrecy or another person subject to an equivalent obligation of secrecy.
In the field of education, students may access the health record with disassociated personal data or simulated medical records provided by the responsible teacher in order to ensure that the learning derived from them respects the privacy and confidentiality of health data.
7.2.2 The Center's management shall authorize access to the health record. The authorization shall be processed by the person responsible for the record, requiring the prior and reasoned report of the tutor or the persons responsible for the research/master/degree/doctorate, which shall be subject to the prior opinion of the corresponding Ethics Committee for Care/Research. This authorization shall have the temporal limits that are appropriate for the specific purpose for which access is authorized.
7.2.3 Only those health data related to the purposes of the research may be used from the health record without revealing characteristics, facts, or circumstances that allow the identification of the patients participating in the study/research in question.
When it is necessary to publish or exhibit medical images or any other audiovisual support that shows parts of the body from which the patient's identity can be inferred, the written consent of the patient will be required.
7.2.4 The activity of researchers in the field of biomedical research and clinical trials shall comply with the provisions of Law 14/2007, of July 3, on Biomedical Research, Royal Decree 1090/2015, of December 4, regulating clinical trials with medicinal products, Ethics Committees for Research with Medicinal Products, and the Spanish Register of Clinical Studies, as well as specific regulations applicable in each case.
7.2.5 Observational studies with human-use medications shall be guided by Order SAS/3470/2009, of December 16, which publishes guidelines on post-authorization observational studies for human-use medications.
7.3 Access to the health record by third parties.
7.3.1 Requests for access to the health record made to students, by patients or involved third parties (family members, legal representatives, etc.) under the right of access recognized in Article 18 of the LBAP, shall be immediately forwarded to the tutor or specialists of the healthcare unit for processing in accordance with the procedures established by each center.
7.4 Access to the Digital Health Record of the National Health System (HCDSNS).
7.4.1 The Digital Health Record System of the National Health System (HCDSNS) allows access to certain clinical documents generated in any Health Service of the National Health System, ensuring that they can be consulted when citizens require healthcare during their travels within the national territory.
7.4.2 Access must be exclusively for healthcare purposes, and healthcare professionals with healthcare functions who have been previously authorized by their health service may access the system.
7.4.3 Therefore, students of health-related disciplines cannot access the system.
7.5 Copies.
Without prejudice to the occasional access to the health record as provided for in sections 7.1.1 and 7.1.3, students, whether residents or trainees, may not make copies of the information contained in the health record through any means or in any format, except with the written consent of the patient or in the case of anonymized health records with the explicit authorization of the responsible party for the medical records registry, upon the proposal of their tutor/educational supervisor.
8.1 Article 7.1 of the LBAP establishes that "every person has the right to the confidentiality of data regarding their health, and no one may access them without prior authorization under the Law."
This right translates into the duty of confidentiality/secrecy provided for in Article 2.7 of said law, which establishes that "the person who prepares or has access to clinical information and documentation is obliged to maintain due confidentiality."
8.2 Both residents and students are subject to the duty of confidentiality/secrecy, not only during their stay in the healthcare center where they are being trained but also after it ends, and this duty is not extinguished by the patient's death.
The duty of confidentiality applies not only to "intimate data" (including psychological data related to ideas, values, beliefs, personal experiences, etc.) but also to the patient's biographical data and their environment (whether intimate or not) whose knowledge by third parties could affect the rights of the person under treatment.
The duty of confidentiality/secrecy applies not only to the data contained in the patient's health record but also to those accessed through verbal communication, recordings, videos, as well as those contained in any type of computer, electronic, telematic file, or public or private registry, including data related to the degree of disability and genetic information.
The duty of secrecy is understood without prejudice to the legal cases in which its maintenance implies a risk to the life of the affected individual or third parties, or harm to public health, in which case it shall be reported to the responsible healthcare professionals of the corresponding service/healthcare unit for appropriate action.
8.3 To this end, all trainees shall subscribe to a confidentiality commitment (see indicative model in Annexes I and II) at the beginning of their stay in the healthcare center where they are being trained, and this commitment shall be recorded in the Register Book for research staff and for students mentioned in section 9, and in the case of residents in training through the residency system, their personal files held by the Teaching Commission shall be kept.
9.1 Register of students in health-related disciplines.
9.1.1 All educational institutions with which healthcare centers have signed collaboration agreements/concerts for teaching/research under applicable legislation, facilitating practical training for their students, must submit to the Center's Management, prior to the start of each academic year, a personalized list of students from each course who will be doing internships in the center, expressly indicating the degree they are pursuing, the responsible teachers mentioned in section 3.4, as well as the schedule and healthcare units involved in the practical training.
9.1.2 The personnel departments of the healthcare institutions or the body designated by their management shall have a "register book of trainee students/research personnel" that complies with the requirements established in the LOPD for the creation of files containing personal data. The aforementioned register shall annually record the mentioned data and the annotation stating that the individual commitment to confidentiality has been signed.
This register, in digital format, shall be accessible from any healthcare unit that wishes to verify that the student is authorized to remain in the center and the respective unit.
9.1.3 It is not necessary for residents in training under the residency system to be registered in the aforementioned register book. Their control, being linked by an employment contract with the entity that owns the corresponding center, shall be carried out by the personnel departments of the Institution responsible for their remuneration payments and by the Teaching Commissions to which the accredited teaching units where the resident is being trained are affiliated.

The patient must provide the necessary information to identify their appointment, such as the patient's name, patient identification number, and the date and time of the appointment they wish to cancel.
If the appointment cancellation is made within a period shorter than indicated in the second point, the Company reserves the right to claim the payment for the visit according to what is established in the subsequent fourth point, unless force majeure circumstances are claimed (*).
(*) Force majeure circumstances are considered to be any unforeseen and inevitable circumstance that alters the conditions for attending the appointment, such as the patient's own illness, accident, urgent hospitalization, or the death of a family member or friend, as well as any travel related to work. Force majeure circumstances do not include situations such as traffic jams, non-work-related trips, or any non-urgent unforeseen events.
Notification Period: A minimum cancellation notice of 72 hours before the scheduled date and time of the appointment is required. The cancellation will be effective once confirmed by our appointment scheduling staff.
Rescheduling Appointments: a. If the patient needs to change the date and time of the appointment instead of canceling it, they are encouraged to inform us at least 72 hours in advance to make the necessary arrangements. Rescheduling is subject to appointment availability, and there may be restrictions depending on the required medical service. If the appointment modification is made within a period shorter than indicated in the previous paragraph, the Company reserves the right to claim the payment for the visit, according to what is established in the subsequent fourth point, unless force majeure circumstances are claimed (*).
(*) Force majeure circumstances are considered to be any unforeseen and inevitable circumstance that alters the conditions for attending the appointment, such as the patient's own illness, accident, urgent hospitalization, or the death of a family member or friend, as well as any travel related to work. Force majeure circumstances do not include situations such as traffic jams, non-work-related trips, or any non-urgent unforeseen events.
Consequences of Late Cancellation or Missed Appointment: Late cancellations or failure to attend the appointment (without prior notice) may result in additional charges of twenty-five (25) euros deducted from the initial payment made by the patient, in accordance with the Company's Refund and Return Policy.
Additionally, at the Company's discretionary discretion, the penalty amount may be waived if the cancellation does not cause any harm to the Company and a future appointment is scheduled. If it is not possible to schedule a future appointment with the patient, the additional amount indicated in the previous section a) will be charged.
The penalty amount may be modified at the discretion of the Company, so to confirm the additional cancellation charge, access to the consultation of the policy is required.
These measures are taken to ensure efficient use of medical resources and to allow other patients to access our services.
Outstanding Obligations: Before cancellation, the patient must fulfill any pending payment related to the appointment or scheduled medical service. If any tests or examinations are required prior to the appointment, the patient must ensure their completion before cancellation.
Changes in the Policy: Air Health Aeronautical Medicine reserves the right to modify or update this appointment cancellation policy at any time. Patients will be notified of any changes through direct communication or publication on our website.
Refund and Return Policy for Medical Services
Refunds: Refunds will only be granted under specific circumstances and at the discretion of our clinic or medical center. Refunds will be considered in the following cases:
To request a refund, the patient must contact our billing team at the following email address: admin@airhealth.es and provide the necessary documentation, such as payment receipts and service details.
Refund Request Process: The patient must submit a written request to our email admin@airhealth.es to request a refund, specifying the reasons for the request and attaching relevant documentation. Our billing team will review the request and determine eligibility for a refund. The patient will be notified of the outcome of the refund request once a decision has been made, within 30 working days from the date of receipt of the communication.
Exclusions from Refund: Refunds will not be granted in the following cases:
Circumstances beyond our control, such as delays or interruptions caused by unforeseen events or emergencies.
Refund Period: Once a refund has been approved, reasonable efforts will be made to process it as soon as possible, within a maximum period of 30 working days from the issuance of the resolution on the refund request. The refund method will be determined by our clinic. The necessary information to process the refund, such as bank details or shipping address, may be requested. Please note that, as indicated in the subsequent Twelfth and Thirteenth points, all personal data communications – of any nature, but especially regarding clinical and banking data – are processed in accordance with Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, as well as any other European or international regulations that may be applicable.
Changes in the Refund and Return Policy: We reserve the right to modify or update our refund and return policy at any time. Patients will be notified of any changes through direct communication or publication on our website.
Buyer Protection Protocol and Data Privacy Policy

Air Health Manifesto regarding the Data Privacy Policy contained in the previous Eleventh to Seventeenth points:
Air Health Aeronautical Medicine (hereinafter referred to as "Company" or "Air Health"), in compliance with current legislation on the Protection of Personal Data, informs users of the website https://airhealth.es/ (hereinafter referred to as the "Website") about the Privacy and Data Protection Policy that will be applied in the processing of personal data voluntarily provided by the User.
By providing Air Health with their personal data, the User expressly consents to the processing of such data in accordance with this Privacy and Data Protection Policy clause and for the purposes expressed in the service agreement formalized between the parties. Likewise, by formalizing the Intermediation Agreement with Air Health, the Patient consents to the recording of telephone calls made to them, all for the purpose of collecting necessary information and providing proper advisory services by the Air Health team. Air Health informs users that their personal data can only be obtained for processing when it is appropriate, relevant, and not excessive in relation to the scope and specific, explicit, and legitimate purposes for which they were obtained. They will be canceled when they are no longer necessary or relevant for said purpose or at the request of the data subject in the exercise of their right to erasure.
Air Health states its commitment to comply with Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (the "LOPD") and any other applicable regulations regarding data protection, at all times.

7.1 Acceso a la historia clínica del servicio de salud con fines asistenciales.
7.1.1 El artículo 15.2 de la LBAP establece que la finalidad de la historia clínica es «facilitar la asistencia sanitaria dejando constancia de todos aquellos datos que bajo criterio médico permitan el conocimiento veraz y actualizado del estado de salud».
Dicha ley en su artículo 16.1 establece que los profesionales asistenciales que realizan el diagnóstico o el tratamiento del paciente tienen acceso a la historia clínica de éste como instrumento fundamental para su adecuada asistencia, sin necesidad del consentimiento del paciente.
Por tanto, los residentes en formación de cualquier año, por ser personal asistencial y trabajadores del Centro, tienen derecho a acceder a la historia clínica de los pacientes implicados en las actuaciones asistenciales que realicen en cada momento. No consultar ni cumplimentar los actos asistenciales en la historia clínica puede tener repercusiones en la seguridad de los pacientes y legales por mala praxis clínico-asistencial.
7.1.2 Los responsables del centro sanitario, a través del servicio administrativo encargado de la gestión del archivo de historias clínicas, facilitarán a los residentes el acceso a la historia clínica mediante un mecanismo de autentificación (habitualmente a través de una tarjeta identificativa y firma electrónica reconocida) que se implantara progresivamente en el plazo de seis meses desde la notificación de este acuerdo a las Consejerías/Departamentos de Sanidad/Salud de las comunidades autónomas y al Instituto Nacional de Gestión Sanitaria.
De conformidad con lo establecido en el artículo 16.7 de la LBAP el procedimiento utilizado garantizará que quede constancia del acceso a la historia clínica y de su uso.
Excepcionalmente los responsables de los centros sanitarios podrán establecer limitaciones de acceso de los profesionales sanitarios a la historia clínica en función del contexto de atención y la política de acceso a la historia clínica del centro sanitario (por ejemplo respecto a los supuestos de violencia de género, política de prensa,…..etc.) siempre que dichas limitaciones, de conformidad con lo establecido en el artículo 76 de la LOPD en relación con el 16 de la LBAP, no perjudiquen la asistencia, prevención y diagnóstico, ni impidan salvaguardar el interés vital del afectado.
En todo caso, las autorizaciones de acceso tendrán carácter temporal y concluirán cuando finalice el periodo formativo, momento en que el centro sanitario procederá a dar de baja al residente en el instrumento que facilite su acceso a la historia clínica.
7.1.3 Con la finalidad de garantizar el respeto a la intimidad y confidencialidad de los datos de salud, los alumnos solo podrán acceder a la historia clínica en los términos previstos por el artículo 16.3 de la LBAP que requiere la previa disociación de los datos clínicos de los personales, para garantizar su anonimato.
Se exceptúa de lo previsto en el párrafo anterior aquellos supuestos en los que el propio paciente haya dado su consentimiento expreso para no alterar ni disociar dato alguno en cuyo caso se adjuntara a la historia clínica dicho consentimiento.
7.2 Acceso a la historia clínica del servicio de salud con fines epidemiológicos, de salud pública, de investigación o de docencia.
7.2.1 La LBAP en su artículo 16.3 establece que el acceso a la historia clínica con fines judiciales, epidemiológicos, de salud pública, de investigación o de docencia obliga a preservar los datos de identificación personal del paciente, separados de los de carácter clínico asistencial, de manera que, como regla general, quede asegurado el anonimato, salvo que el propio paciente haya dado su consentimiento para no separarlos.
La disociación de datos obliga a separar los datos de utilidad científica (clínico-asistenciales en nuestro caso) de aquellos otros que permitan identificar a su titular (número de historia clínica, de la Seguridad Social, DNI, etc.). La disociación de datos habrá de realizarla un profesional sanitario sujeto al secreto profesional u otra persona sujeta a una obligación equivalente de secreto.
En el ámbito de la docencia los alumnos podrán acceder a la historia clínica con datos personales disociados o historias clínicas simuladas por el responsable de docencia a fin de garantizar que el aprendizaje derivado de las mismas se realiza respetando la intimidad y confidencialidad de los datos de salud.
7.2.2 La dirección del Centro autorizará el acceso al registro de la historia clínica. La autorización se tramitará por el responsable del registro requiriendo para ello el informe previo y motivado del tutor o los responsables de la investigación/master/título propio/doctorado que se someterá a dictamen previo del correspondiente Comité de Ética Asistencial/Investigación. Dicha autorización tendrá los límites temporales que se adecuen a la finalidad concreta para la que se autoriza el acceso.
7.2.3 Sólo se podrán utilizar aquellos datos de la historia clínica relacionados con los fines de la investigación sin revelar características, hechos o circunstancias que permitan identificar a los pacientes que participen en el estudio/investigación de que se trate.
Cuando sea necesaria la publicación o exhibición de imágenes médicas o cualquier otro soporte audiovisual que muestren partes del cuerpo de las que pueda deducirse la identidad del paciente, se requerirá el consentimiento escrito de éste.
7.2.4 La actividad de los investigadores en el ámbito de la investigación biomédica y de los ensayos clínicos, se adecuará a lo previsto en la Ley 14/2007, de 3 de julio, de Investigación biomédica, en el Real Decreto 1090/2015, de 4 de diciembre, por el que se regulan los ensayos clínicos con medicamentos, los Comités de Ética de la Investigación con medicamentos y el Registro Español de Estudios Clínicos, así como en la normativa específica que resulte de aplicación en cada caso.
7.2.5 Los estudios observacionales con medicamentos de uso humano se guiarán por la Orden SAS/3470/2009, de 16 de diciembre por la que se publican las directrices sobre estudios post-autorización de tipo observacional para medicamentos de uso humano.
7.3 Acceso a la historia clínica del servicio de salud por terceros.
7.3.1 Las solicitudes de acceso a la historia clínica que se formulen ante el personal en formación, por los pacientes o por terceros implicados (familiares, representante legal,….) al amparo del derecho de acceso reconocido en el artículo18 de la LBAP, se trasladaran con carácter inmediato al tutor o especialistas de la unidad asistencial para su tramitación según lo establecido por cada centro.
7.4 Acceso a la Historia Clínica Digital del SNS (HCDSNS).
7.4.1 El sistema de Historia Clínica Digital del Sistema Nacional de Salud (HCDSNS) permite acceder a determinados documentos clínicos, generados en cualquier Servicio de Salud del SNS, garantizando que puedan ser consultados cuando los ciudadanos requieran atención sanitaria en sus desplazamientos por el territorio nacional.
7.4.2 El acceso ha de realizarse con fines exclusivamente asistenciales, pudiendo acceder al sistema los profesionales sanitarios con funciones asistenciales que hayan sido previamente autorizados por su servicio de salud.
7.4.3 No pueden acceder, por tanto, alumnos de titulaciones relacionadas con las ciencias de la salud.
7.5 Copias.
Sin perjuicio del acceso puntual a la historia clínica según lo previsto en los apartados 7.1.1 y 7.1.3, el personal en formación ya sea residente o alumno, no podrá realizar copias de la información contenida en la historia clínica por ningún medio y en ningún formato, salvo consentimiento escrito del paciente o en el caso de historias clínicas anonimizadas con autorización expresa del responsable del registro de historias clínicas a propuesta de su tutor/responsable docente.
8. Derecho de los pacientes a la confidencialidad de sus datos de salud
8.1 El artículo 7.1 de la LBAP establece que «toda persona tienen derecho a que se respete el carácter confidencial de los datos referentes a su salud y a que nadie pueda acceder a ellos sin previa autorización amparada en la Ley».
Este derecho se traduce en el deber de confidencialidad/secreto previsto en el artículo 2.7 de dicha ley que establece que «la persona que elabore o tenga acceso a la información y la documentación clínica está obligada a guardar la reserva debida».
8.2 Tanto residentes como alumnos están sometidos al deber de confidencialidad/secreto, no solo durante la estancia en el Centro sanitario en el que se esté formando sino también una vez concluida la misma, sin que dicho deber se extinga por la defunción del paciente.
El deber de confidencialidad afecta no solo a «datos íntimos» (incluidos los psicológicos relativos a ideas, valores, creencia, vivencias personales…) sino también a datos biográficos del paciente y de su entorno (sean íntimos o no) cuyo conocimiento por terceros pueda afectar a los derechos de la persona objeto de tratamiento.
El deber de confidencialidad/secreto no solo se refiere a los datos contenidos en la historia clínica del paciente sino también a los que se ha tenido acceso mediante comunicación verbal, grabaciones, videos, así como a los contenidos en cualquier tipo de archivo informático, electrónico, telemático o registro público o privado, incluidos los referidos al grado de discapacidad e información genética.
El deber de secreto se entiende sin perjuicio de los supuestos legales en los que su mantenimiento implique riesgo para la vida del afectado o de terceros o perjuicio para la Salud Pública, en cuyo caso se pondrá en conocimiento de los responsables asistenciales del correspondiente servicio/unidad asistencial para que se actúe en consecuencia.
8.3 A tal fin todo el personal en formación suscribirá al inicio de su estancia en el centro sanitario, donde se esté formando, un compromiso de confidencialidad (ver modelo indicativo en los Anexos I y II) que constará en el Libro Registro para el personal investigador y en régimen de alumnado al que se refiere el apartado 9, y en el caso de los especialistas en formación en los expedientes personales de los mismos que custodia la Comisión de Docencia.
9. Disposiciones finales
9.1 Registro de alumnos de titulaciones relacionadas con las ciencias de la salud.
9.1.1 Todas las instituciones docentes con las que los centros sanitarios hayan suscrito al amparo de la legislación aplicable, convenios/conciertos de colaboración para la docencia/investigación, facilitando la realización de prácticas por sus alumnos, deberán remitir a la Gerencia del Centro, con carácter previo al inicio de cada curso académico, relación personalizada de los estudiantes de cada curso que realizaran prácticas en el mismo, con indicación expresa de la titulación en la que se estén formando, de los responsables docentes citados en el apartado 3.4, así como el calendario y unidades asistenciales implicadas en la realización de las prácticas.
9.1.2 Los servicios de personal de las instituciones sanitarias o el órgano que determine la Gerencia de los mismos, dispondrán de un «libro registro de alumnos en formación/personal investigador» que cumplirá los requisitos establecidos en LOPD para la creación de ficheros que contienen datos personales. En dicho registro se volcaran anualmente los datos citados y la anotación relativa a que se ha suscrito el compromiso individual de confidencialidad.
El citado libro, en formato digital, será accesible desde cualquier servicio asistencial que quiera constatar que el alumno está autorizado para permanecer en el centro y servicio de que se trate.
9.1.3 No será necesario que se inscriban en el citado libro registro los especialistas en formación por el sistema residencia, cuyo control, al estar vinculados mediante un contrato laboral con la entidad titular del correspondiente centro, se llevará a cabo por los servicios de personal de la Institución responsables del pago de sus retribuciones y por las Comisiones de Docencia a las que están adscritas las unidades docentes acreditadas en las que el residente se esté formando.
